A fresh asylum hearing will be taking place on the 9.11.09 at 14.30 in Sigmaringen. Coincidentally, the same day makes it exactly 4 years after my first abnormal interview at the BOMF (German Office für Migration and refugees) Durlach Allee in Karlsruhe.
The whole process started with my Case Officer Mr H. who confirmed his position to frustrate me in the process just because i refused to be threatened with his intimidation.
He gave me no space to really explain my situation. He always interrupted me by seeing my explanation as irrelevant and that i have to answer his quetion directly without linking the past. I tried making him understand that the past connection stands as the only way to picture the whole situation which he refused to accept but rather became aggressive.
He insisted that it was better to claim my journey was through the sea rather than by air.
He claimed I lied about being a civil servant otherwise I cannot speak against my employer. (Now confirmed by the German embassy to be true)
We discussed about me being accused of hijacking a congress (having to do with disrupting a process) but he interpreted it as hijacking persons. The interview turned into an English lecture session. I had to make it clear to him that I rather would teach him English and not otherwise.
He confronted me with great insecurity hence I was not feeling safe to mention public figures who supported me during my escape because they served in sensitive capacities for the then administration. I told him that I could only mention their names when I am guaranteed of them not being fingered.
By legal standard, I had that right to do so.
Mr H was only interested in manipulating my statements just to establish his prejudice.
This interview was nothing different from the Nigerian police abnormal procedure of extracting statements from innocent Victims to criminalize them.
Another Nigerian room mate was also his victim on that same day. The same Mr. H according to him (room mate), engaged him in mockery to the extent of imposing an assumed age for him.
Just as I envisaged, Mr. H slammed me with a rejection "OFFENSICHTLICH UNBEGRÜNDET" which I appealed against the negative decision by lawyer Mr. Sczlenzy who claimed he could handle my case even without discussing my experience with me.
Based on my BOMF-Karsruhe experience, I insisted on him discussing with me to know exactly my situation directly but he said it was not necessary.
Notwithstanding that, I took time to put the whole situation in writing and submitted it to him some few days later. Unfortunately, I got a second rejection because the Mr. S wrote an appeal that had no point to be considered by the deciding Judge.
I change my legal representative to one Mr. Strieder near Frankfurt. He appealed against the decision and I was given the opportunity to appear in court for a verbal hearing in the administrative court (VG) Sigmaringen.
At this second hearing (2006) in Sigmaringen, I presented original evidence documents to the court through my lawyer. Unfortunately, the decision justified Mr. H. of the BOMF as one would expect a colleague to do. The presiding judge Mr. G acted as magician as he claimed the documents were not trusted. I suggested a verification process through the German embassy in Nigeria rather than mere assumption. He told me that was not necessary.
Complicated as things could be, BOMF, VG and Regierungspräsidium (RP) claimed I am responsible for researching my case. I tried various attempt to get information and make research through some recognized institutions here in Germany but was confronted with the inhuman district restriction (Residenzflicht) policy.
I was under the pressure of deportation. The foreigners' authority even assumed me to have not been Nigerian although the Nigerian embassy had confirmed in writing to them earlier on.
Disappointing enough was that my lawyer, Mr. Strieder all of a sudden turned out working against me after i expressed my disappointment in his not representing me well enough. Mr. Strieder carelessly lost my Original evidence documents with no attempt of conducting a search at the post office he claimed he had sent them through unregistered.
At the heat of the whole process, I got contact to a new lawyer Frau Behrens in Berlin.
On meeting with her she picked up some points that failed in the whole process and took interest to take up the case. It was in the process of her intervention that we found out that my Sigmaringen hearing in 2006 had a blank protocol with no copy of the evidences left in neither my file at the court nor the Regierungspräsidium.
It became clear to me that the Regierungspräsidium had refused to release my files to my lawyer just to cover up the abnormalities and frustrate her effort.
Mr. Andermah from the RP in the process claimed to my Lawyer that I had no chance as my deportation is already concluded with a booked flight for October 2007.
Just to show how some public officers could toy with people's life out of sheer wickedness, his superior confirmed that information as untrue whencontacted by a state legislator.
Through active support of my new lawyer, I personally had to submit a 50 paged second asylum application in Karlsruhe in 2007. BOMF in less than 24
hours rejected the application based on Prejudice rather than legal grounds as the administrative court later confirmed.
When the BOMF President was contacted through a federal legislator, Mr. Smith justified the handwork of his boys as one will expect from the system as far as it concerns asylum.
The Switzerland refugee council had a positive expert report on this case but trust the
German Foreign office and its so called expert report, Nigerian-German mutual Political interest?.
Thanks to my Lawyer Frau Behrens, to members of my church community and
individuals from both the public service and members of the wider community who supported the struggle further.
Activists of The Voice Refugee Forum, the Caravan for the rights of refugees and migrants and other groups who inspired my courage through their shared personal experiences that kept me stronger in spite of the State Pressures.
Together with the Networks of The VOICE Refugee Forum, The Caravan for the rights of refugees and migrants, Nigerian - African Community Forums, Human rights groups and activists I have been able to raise much of the public awareness against the Nigerian Embassy's abuses of human rights in collaboration with the German state and on the negligence of his citizens abroad like in Germany with the ongoing human right abuses in Nigeria.
Politicians from CDU, SPD and the Grüne Party on individual capacity impacted greatly to influenced my been allowed a fresh hearing that led to my deportation suspension.
We hope for the actualization of a fair standard as imbibed in the Universal declaration without prejudice and inhuman State asylum manipulations.
