Following Monday events(see details in protocol below in English and German), there has been contact late Tuesday 25th September to lawyer Claus Föster who is willing to join me to the AusländerbehordeBerlin for extending of my Travel Document and residence Permit.

He confirms that the Judge burrying my files at the Berlin administrative court forwarded them to the Auslanderbehorde Berlin. No confirmation at the Ausländebhorde has reach us about this.

Today Wednessday 26th September 2007, the AusländerbehordeBerlin is not open to public but lawyer Föster is trying to reach them to confirm the presence of the files.

When the Ausländerbehorde would argue that my files have still not reached them yet, I will ask for a provisional title as a political refugee to travel and return to Germany with the lawyer right there.

Lawyer Claus will immediately accompany me to the airport Schonefeld with this. My ticket is booked to London Thurday evening 21 55pm.

Without the files, the lawyer plans to renew my application for a „Fiktionsbescheinigung “(fictional certificate ) which is a document stating that a person has applied for an extension but the extension has not been granted yet. This is to be issued automatically an application is done given „standard procedure“ even without files. Nevertheless we note that during my last application for an extension and a Fiktionsbescheinigung on 02.07.2006 the Judge of the Administrative Court of Berlin -Judge Noordin- sent a letter to the AuslandebehordeBerlin to tell me they were not responsble. At the sametime as my lawyer had protested against this as court bias. In return the Judge and the two other judges of his chamber replied with an order that I should deregistration-“abmeldung“ out of the City of Berlin to Darmstadt city if I want any Justice.

The presence of activists is solicited for Thursday at theAusländebehordeBerlin. The responsibility to act over the Travel document extension and over any renewed application is re-enforced by activist concious presence and participation. The authorities donot even want to regard their own laws not even after they have been revised such as in this case the Änderungs-gesetzes wohnsizauflage(-Revisionay law) and UNHR complaint which obliges Berlin authorities to take responsiblity.

I am withdrawing no case from the Verwaltungsgericht. All cases stay without any withdrawal.

Urgent – Recount between ABH, Court and Gaston Ebua

Dear lawyers,

On the 21.09.2007 an enquiry with the responsible representative of the 21. chamber/court of the administrative court in Berlin, Mr. Born, showed that files of Mr. Ebua had already been sent back to the aliens department on the 14. 06.2007.
Consequently, Mr Ebua called on the aliens department in person today, the 24.09.2007. He was accompanied by 12 acquaintances / witnesses
The responsible official, Mr Kießwetter made use of the domestic authority and expelled 11 of them from the house.
Further on Mr Kießwetter pointed out that the files were in possession of the administrative court and that he could not handle the lawyer’s application for the issue of a residency permit and for extension of Mr Ebua’s passport without them.
An application for the return of the documents had already been filed to the administrative court by telephone on the 21.09.2007. The information was outdated, though, and the files were handed in for processing the case VG 21 A 138.07.
After a telephone communication with Mr Born, it turned out, though, that such an application for return from the aliens department was, it was not in the hands of the responsible chamber. However, the chamber was still in possession of two files from the city of Darmstadt. After further interlocution with Mr Kießwetter it emerged that the aliens department in Berlin had compiled no records on Mr Ebua and worked on the files of Darmstadt only which are the ones required.
On insistence Mr Kießwetter agreed to immediately call the responsible chamber to get a binding time when the files had to be on his desk.
The responsible judge assured to send the files that same morning, so that it would be at the aliens department on the 25.09.2007.
However, Mr Kießwetter pointed out that a handling of the application for the issue of a residency permit and for extension of the passport was not possible as long as there was an application for interlocutory relief/temporary legal protection pending with the administration court. This caused a dilatory/suspensory effect which prohibited the handling of lawyer Behrens’ application. But an immediate handling of the application would be possible in case of a withdrawal of action at the administrative court.
Since Mr Ebua wishes to register at Roehampton University as soon as possible, a withdrawal of action would come into question as long as the aim of his action can be reached on administrative channels.
A registration was possible until the 21.09.2007. As classes began today, on the 24.09.2007, travelling to London is essential for Mr Ebua to clear the circumstances, since the study fees have already been transferred. This necessitates Mr Ebua to travel on Thursday, 27.09.2007. Therefore, it is desirable to find an agreement between the aliens department, the court and Mr Ebua as soon as possible, so that he receives the allowance of his application by Thursday. The aliens department is closed on Wednesday.
Therefore, I would like to ask you for confirmation if you had the time capacity to complete this until Thursday, or if you may have the possibility to confer the case to a colleague who is able to help Mr Ebua.

Betr.: Bericht zwischen ABH, Gericht und Herrn Ebua

Sehr geehrte Frau Rechtsanwältin,

eine Anfrage vom 21.09.2007 beim zuständigen Berichterstatter der 21. Kammer des VG Berlin, Herrn Born, ergab, dass die Ausländerakten Herrn Ebuas bereits am 14.06.2007 an die ABH zurückgesandt wurden. Daraufhin sprach Herr Ebua heute in Begleitung von 12 Personen bei der ABH vor. Gegen 11 von Ihnen machte der zuständige Sachbearbeiter Herr Kießwetter von dem Hausrecht Gebrauch und verwies diese des Hauses. Herr Kießwetter verwies allerdings weiterhin darauf, dass die Akten sich im Besitz des VG befinden, und er ohne die Akten den am 19.09.2007 von RAin Behrens gestellten Antrag auf Ausstellung der Aufenthaltserlaubnis und Verlängerung des Reiseausweises nicht bearbeiten können. Ein Antrag auf Rückführung der Unterlagen sei bereits am 21.09.2007 an das VG telefonisch ergangen. Die Auskunft sei überholt, und die Akten seien nach dem 14.06.2007 zur Bearbeitung der Sache VG 21 A 138.07 eingereicht worden. Nach einem Telefonat mit Herrn Born, stellte sich allerdings heraus, dass ein solcher Antrag auf Rückführung seitens der ABH nicht der zuständigen Kammer vorläge. Allerdings sei die Kammer weiterhin im Besitz zweier Ausländerakten der ABH Darmstadt. Nach weiterer Unterredung mit Herrn Kießwetter stellte sich heraus, dass die ABH Berlin keinerlei Akte über Herrn Ebua führte, und diese lediglich anhand der Ausländerakten der Stadt Darmstadt, arbeitete. Allerdings handle es sich um die benötigten Ausländerakten. Auf Drängen hin, ließ sich Herr Kießwetter auf ein Telefonat mit der zuständigen Kammer, in dem ein verbindlicher Termin, wann denn die Akten vorlägen, vereinbart werden sollte, ein. Der zuständige Richter versicherte ihm die Akten noch am Vormittag zu versenden, so dass diese am Dienstag den 25.09.2007 bei der ABH Berlin vorliegen werden. Herr Kießwetter verwies allerdings darauf, dass eine Bearbeitung des Antrages auf Ausstellung einer Aufenthaltserlaubnis und die Verlängerung seines Reiseausweises nicht möglich wären, so lange beim VG noch ein Antrag, auf Einstweiligen Rechtsschutz anhängig sei, der eine aufschiebende Wirkung entfalte, welche die Bearbeitung des von RAin Behrens gestellten Antrages verhindere. Allerdings sei bei einer Rücknahme der Klage beim VG eine unverzügliche Bearbeitung des Antrags möglich.
Da Herr Ebua sich schnellstmöglich bei der Roehampton University in London immatrikulieren möchte, würde eine Rücknahme der Klage durchaus in Frage kommen, solange sein Klageziel auf Verwaltungswege erreicht werden kann. Eine Immatrikulation war bis Freitag den 21.09.2007 möglich. Da die Vorlesungen bereits am 24.09.2007, also heute begonnen haben ist es für Herrn Ebua wichtig nach London zu fahren und die Sachlage zu klären, da bereits die Gebühren an die Universität abgeführt wurden. Dies würde allerdings ein Reise Herrn Ebuas bereits am Donnerstag 27.09.2007 notwendig machen. Daher wäre es erstrebenswert eine Einigung zwischen ABH, Gericht und Herrn Ebua schnellstmöglich zu erreichen, damit dieser die Bewilligung seines Antrags bis Donnerstag erhält. Die ABH ist zudem am Mittwoch geschlossen.
Daher würde ich um eine kurze Rückmeldung bitten, ob Sie die zeitliche Kapazität haben, dies bis Donnerstag zu erledigen, oder vielleicht die Möglichkeit haben die Sache an eineN Kollegen/in zu verweisen, der/die Herrn Ebua in diese Sache weiterhelfen kann.

This is a spontaneous appeal to activists to join my going to the Berlin German Ausländerbehörde inorder for this office to comply and undertake jurisdiction of my UN German Travel Document and residency permit. For several years they rejected this and now have to do this without substituting or issuing any residency restriction or Wohnsitzauflage nor any further kind of restriction.

Someone somehow right here has got be responsible.

A brief Report after a recent visit attempted on the 18th of September 2007 with short background information..

On this day, I visited the AusländerbehördeBerlin with my Roehampton London University registration letter, a UNHCR letter on my case from 07 June 2007, an Interim Order known as Wohnsitzauflageresidenzpflicht-Änderungsgesetz-Revisionary-law to uplift spartial or residency restriction (which became effective on 1st September 2007). These were sent to the Ausländerbehörde Berlin to re-enstate my Travel Document and residency permit extension without any restriction with a letter from the Job-Center asking for the state of things. The visit to the Ausländerbehörde Berlin has been during opening hours following a telephone communication with my lawyer who said I should take the papers there and tell them it is urgent.

Accompanied by Mr Toby Becker to the Ausländerbehörde Berlin, I have been sent to meet with the responsible individuals on my case. They refused to accept that I have an urgency by telling me that they do not know the reason I am in their office at all without a valid Travel Document and residence permit. The civil servant questioned me saying I have lived in this country for so long and still did not speak German to her when I have been conversing with Mr Becker to ignore her arrogance. Before I had even finished my discussion with Mr Becker telling him to stay quiet since everything is already on paper and insisting on them to read it , Mr Becker was already questioning her in German that she has been working so long in this foreign office and was not able to speak English; Why? The Official fell immediately silent. It was all silent for almost two hours. I then said I did not feel as to leave this building and would not leave without a statement stamped by them confirming that I am in there with all documents. Only after this she reluctantly picked up my lawyer’s letter and stamped the date of 18th September 2007 and hand wrote 25.10.07, 1200h signing it without a name. I later pushed forward the Job Center letter and Travel document. She stamped the Job Center letter completely ignoring my Travel Document. We waited for more than 3 hours in all. After that she also said that if they found my file, they would talk again with my lawyer.

I have immediately told this to my lawyer who said at first instance she was surprised that I was not issued any valid papers.
She immediately sent a complaint telling the Ausländerbehörde Berlin that her client would be returning to the Ausländerbehörde on Tuesday 25th September 2005 as berlin is juristically responsible and another lawyer would assist me on Monday 24.September 2007.This assistance will have to take place during opening hours of the AusländerbehordeBerlin since my lawyer will not be in Berlin.

My lawyer was later informed by the Ausländerbehorde in Berlin that they did not have my file and had asked for it from the court in Berlin “as fast as possible.” They would send me an invitation as soon as they had received it. My lawyer immediately told her colleague who is to assist me on Monday 25th September at the Ausländerbehörde Berlin . My lawyer also told the UNHCR and her office assistant that my file is being asked for from the Verwaltungsgerichts Berlin and that this could take 2 weeks. Unfortunately my lawyer’s colleague made up her mind not to come on this informationgiven Monday. At the same time, the situation turned upside down creating huge doubts about the official sincerity of the Ausländerbehörde Berlin when on Friday 21 st September 2007 I got a statement from my lawyer’s office contradicting the Ausländerbehörde Berlin’s statement. This statement informs me that contrary to the Berlin office’s opinion, the court says that all files concerning me since 14.06.2007 have been sent to the Ausländerbehörde Berlin to the custody of Frau Ruhland. Till now, there is no information from the Ausländerbehörde which file they wanted to get from the Berlin court.

On Monday 24 september 2007, I therfore will move to the Ausländerbehörde Berlin to find out about the complete whereabouts of my file and to demand an immediate juristiction in order to enable me travelling this month for university registration in London.

Short Background Information:
Gaston Ebua of The VOICE Africa and Refugee forum who faces German-Ausländerbehörde in Berlin on Monday 8 am is expected to urgently travel to London for registration at Roehampton university which is once more pending since the middle of september 2007.

The German Ausländerbehörde in Berlin is refusing to register Mr Gaston Ebua’s UN Geneva Convention German Travel Document and denies any jurisdiction over his Travel Document and residency permit that they themselves extended in August 2004 while he was living in Berlin imposing him a residency restriction to Darmstadt city.

The denial of jurisdiction to register his Travel Document since then caused him living without an administrative stay in Germany till today. He is being charged administratively for living illegally in Germany. He is without any form of legal protection being offered neither by the Administrative courts despite serveral appeals.

The non-registered two-year extension of his Travel Document and residency permit (having residency restriction for the city of Darmstadt issued by the administration of Berlin) found inside the Travel Document ran out on the 11th of August 2006. During this period he suffered two airport arrests on his way to London. This caused heavy interruption of his London university schedule by making him unable to catch up till now. In September 2006 the Administrative court in Berlin refused to decide on an appeal for an interim order to allow Mr Ebua register at the University in London. This appeal is still pending today despite his allowance by the British Authorities into Britain.

The University of Roehampton London has once again contacted Mr Ebua allowing him to register until September 2007. His registration formalities are to be made in person between 17 and 21 September 2007 since classes begin Monday 24th September 2007.
