Press release: Berlin, May 17, 2009
Initiative in Memory of Oury Jalloh continues efforts to establish an independent international commission.
- Written judgement of the court contradicts the oral rendition of the judgement from December, 2008, once again confirming the necessity of an independent commission.
- Initiative in Memory of Oury Jalloh organised the second preparatory meeting for the establishment of an 'independent international commission' on May 9, 2009, in Hanover.
The written judgement was provided by the court in March, 2009. This is not the first time that Judge Steinhoff has revealed himself to be part of the political farce orchestrated to deceive the public. Although in December of last year Judge Steinhoff spoke before the cameras and bemoaned the fact that the obstructive behaviour of the police prevented the court from determining the truth, absolutely nothing of the sort could be found in his written judgement.
No word is mentioned of the cover-ups, the wall of lies erected by the police witnesses or any of the demanding yet still unanswered questions. Instead, with the sole exception of Beate H., the court describes all police witnesses as "believable". Moreover, all actions of the police witnesses are altered in such a manner so that they appear comprehensible and in good conscious. Consequently, we have and will continue to denounce the all so evident contradictions in their entirety. These inconsistencies are also contained in the written judgement and deserve just as strong a denunciation now as they have from the very beginning.
In their analysis of the judgement, the German-based 'Kommittee für Grundrechte und Demokratie' [Committee for Basic Rights and Democracy] has determined: “Out of the overabundance of negligent acts, if this term is even appropriate, a system is cultivated that produces mortal results".
Indeed, the written judgement has finally made clear that the truth about Oury Jalloh's death shall not escape the system's suppression of the facts. As a result, the only way that the truth can finally be made known is through the establishment of an independent international commission.
The goal of the commission will be to elucidate the true history of Oury Jalloh's life in the refugee lager in Sachsen-Anhalt, the circumstances surrounding his death as well as the cover-ups and deceptions of the investigations by state authorities. In this manner, a precedence can be set for other cases of deadly police violence against people of non-German heritage which still remain unclear today.
A preparatory group has already begun laying the foundation for the establishment of the commission. At the moment, family members and victims of police brutality are being consulted as to their possible participation in the commission. In addition, supporting organisations and individual jurists have already concluded their legal analysis of the court's judgement.
The independent commission will consist of three main 'pillars':
- experts and specialists
- human rights activists
- victims of racist police violence and their families
The preparatory group has been given the responsibility to ensure that these three pillars come together.
We have attached a document to this press release for all individuals or groups who would like to work with us in the establishment of an independent commission so that together we may raise our voices of protest and unmask the farce behind the court proceedings and the so-called 'justice system'. As renowned German jurist Erich Buchholz said about the case: "However it may be, the possibility of a suicide [is] ruled out".
Four years after Oury Jalloh's bestial death in Cell No. 5 in Dessau, we continue to denounce:
Oury Jalloh was murdered!
and demand:
Truth! Justice! Reparations!
